End User License Agreement

Hostinc grants you a limited, non-exclusive, non-transferable license to access and use the Services in accordance with this Agreement, for your internal business purposes. This license is subject to your compliance with the terms and conditions herein.

You may not:
Copy, modify, distribute, sell, lease, or sublicense the Services. Reverse engineer, decompile, or disassemble any part of the Services. Use the Services for unlawful or unauthorized purposes. Transfer the Services or sublicense your rights under this Agreement to any third party.

Hostinc uses third-party services and licenses, such as payment gateways and other software solutions, to deliver the Services. These third-party licenses are governed by their respective terms and conditions. You agree to comply with any applicable terms and conditions of these third-party licenses. Hostinc is not responsible for any third-party service or software, including any issues related to the payment gateway or other external services.

Hostinc may integrate payment gateway services as part of its Solutions. You acknowledge and agree that these payment services are governed by separate terms and policies of the third-party payment processor. By using such services, you agree to abide by their terms, including any applicable fees, privacy policies, and security practices.

Hostinc don't provide individual support for applications or software,nor do we take responsibility for the performance or availability of third-party licenses and software, including but not limited to payment gateways.Support will be provided through email, phone, or other means as outlined in the service level agreement(SLA).

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to immediately notify Hostinc of any unauthorized access or use of your account.

You agree to comply with applicable data protection laws and understand that Hostinc will process and store your data according to our Privacy Policy. You retain ownership of your data, but you grant us the necessary rights to process, store, and transfer your data in the course of providing the Services.

You agree to indemnify, defend, and hold harmless Hostinc, its officers, employees, agents, and affiliates from any claims, damages, losses, or expenses arising out of or related to your use of the Services, including any violation of third-party licenses or the terms of this Agreement.

To the maximum extent permitted by applicable law, Hostinc shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits or data, arising out of the use or inability to use the Services, even if Hostinc has been advised of the possibility of such damages.

The Services are provided "as is," and Hostinc makes no representations or warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the Services will be error-free, secure, or free from defects.

This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to this Agreement shall be resolved through arbitration in Jaipur, Rajasthan, India, under the rules of the Arbitration and Conciliation Act, 1996.

Entire Agreement: This Agreement constitutes the entire agreement between you and Hostinc with respect to the Services and supersedes all prior agreements or understandings. Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect. Amendments: Hostinc may amend this Agreement at any time. We will provide notice of changes, and your continued use of the Services will constitute acceptance of the updated terms. By accessing and using Hostinc's Services, you acknowledge that you have read, understood, and agreed to the terms and conditions set forth in this End User License Agreement.
